  3. BAILMENT AGREEMENT

  6. ____________________________, referred to herein as "OWNER" and 
  7. ____________________________, referred to as  "BORROWER," agree:

  10. _______________ is the owner of the following personal property:

  15. OWNER herewith bails to BORROWER the personal property described
  16. above, for a period of _________, for the purpose of ____________
  17. ________________. BORROWER  agrees to return the same to OWNER in
  18. good condition, ordinary  wear and excepted.

  20. THIS IS A BAILMENT WITHOUT PAYMENT FROM BORROWER TO OWNER FOR THE
  21. LENDING.

  23. BORROWER acknowledges an opportunity to review the personal
  24. property bailed, and ACCEPTS THE SAME "AS IS," "WITH ALL FAULTS"
  25. and WITHOUT WARRANTY. BORROWER HAS ASCERTAINED THAT THE BAILED
  26. PROPERTY IS FIT FOR THE PURPOSE THAT BORROWER DESIRES TO USE THE
  27. BAILED PROPERTY.

  29. OWNER is not a "merchant" as the same is defined in the Uniform
  30. Commercial Code.
  31.  
  32. The BORROWER shall at all times maintain insurance coverage for
  33. all insurable perils on the personal property bailed herein in a
  34. minimum amount of $________, and OWNER shall be named as a loss
  35. payee  and co-insured thereon. OWNER may obtain such coverage for
  36. BORROWER, and at BORROWER's expense, if the same is not obtained
  37. and proof thereof given to OWNER.

  40. The BORROWER agrees to indemnify and hold harmless OWNER from any
  41. and all liability which may accrue as a result of BORROWER'S use
  42. of the bailed property.

  44. The OWNER may terminate this bailment prior to the expiration of
  45. the same which is specified herein for cause, including but not
  46. limited to:
  47.  
  48. a. the intentional misuse or neglect of the bailed property;
  49.  
  50. b. the use of the bailed property in contravention of any statute
  51. or administrative regulation;
  52.  
  53. c. other objectively reasonable cause.
  54.  
  55.  
  56. Said termination shall be effective immediately upon ____________
